A legal expert has described as unconstitutional the act of a police officer arresting any member of the family of a suspected offender in lieu of the suspect.
Barrister Ekemini Udim of Justice Chambers in Uyo who stated this when he spoke with planet news said in law, criminal liability is not transferrable and as such it was illegal for any relative to be arrested for a crime committed by another member of the family.
While urging the Police to always go for the suspect once a complaint is lodged, the legal Luminary advised people who are arrested for crimes not committed by them to always file a case in court of breach of fundamental human right by the force.
Our correspondent Jane Uwa reports that Barrister Udim also charged the police force to at all-time look at the provisions of the constitution of the federal republic of Nigeria to guide them properly in the discharge of the duties.
